Terms of Use

1. Acceptance of these terms

These Terms of Use ("Terms") govern your use of the Yonder app and the yondergame.com website, provided by Understudio LLC ("we," "us"). By downloading, accessing, or using Yonder, you agree to these Terms. Because Yonder is intended for children, an adult parent or guardian must accept these Terms and supervise a child's use. If you do not agree, do not use the app.

2. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use Yonder for your family's personal, non-commercial use, subject to these Terms and to the App Store terms under which you obtained the app. This license does not transfer any ownership of the app or its content to you.

3. Acceptable use

You agree not to: (a) copy, modify, reverse-engineer, or create derivative works of the app except as permitted by law; (b) resell, rent, or redistribute the app; (c) attempt to gain unauthorized access to our systems or other users' data; or (d) use the app in any unlawful way.

4. Accounts and family use

Accounts are optional and are created and managed by an adult. You are responsible for keeping your account credentials and family PIN confidential and for activity under your account. Progress data and how we handle information are described in our Privacy Policy, which is incorporated into these Terms.

5. Purchases

Yonder may offer one-time in-app purchases to unlock additional content. All purchases are processed by Apple through the App Store and are subject to Apple's terms. Purchases are generally non-refundable except as required by law or by Apple's policies; refund requests are handled by Apple.

6. Content and intellectual property

The app, including its characters (such as Captain Ellis), artwork, text, software, and design, is owned by us or our licensors and is protected by intellectual-property laws. You may not use our names, logos, or content without our prior written permission.

7. Educational content disclaimer

Yonder is an educational aid provided for general learning. While we strive for accuracy, we do not warrant that all content is error-free or suitable for any particular curriculum or assessment.

8. Disclaimer of warranties

The app is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

9. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or relating to your use of the app. Our total liability for any claim relating to the app will not exceed the greater of the amount you paid us for the app in the twelve months before the claim or fifty U.S. dollars ($50).

10. Apple as a third-party beneficiary

These Terms are between you and us, not with Apple. Apple is not responsible for the app or its content. To the extent the app is obtained through the App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them. Maintenance and support of the app are our responsibility, not Apple's, as further described in Apple's standard EULA terms.

11. Termination

You may stop using the app at any time by deleting it. We may suspend or end your access if you violate these Terms. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.

12. Changes to these terms

We may update these Terms from time to time. Material changes will be posted here with a new "Last updated" date. Your continued use after an update means you accept the revised Terms.

13. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules, except where local consumer-protection law provides otherwise.
